SECTION 1 - ACCESS, ACCOUNTS, AND ADULT RESPONSIBILITY

By agreeing to these Terms, you represent that you are at least the age of majority in your state of residence and are legally authorized to enter into this agreement.

Because many Mini Builders Play Co. activities are intended for children, all bookings, purchases, agreements, and event arrangements must be made by a parent, legal guardian, or other responsible adult who has authority to make decisions regarding the participating children.

Children may participate in our activities only with the permission of their parent or legal guardian.

You may be required to provide information such as your name, email address, telephone number, event information, billing information, payment information, participant information, or other details necessary for us to provide the Services. You represent that all information you provide is accurate, current, and complete.

You are responsible for maintaining the security of any account credentials associated with our website and for activity performed through your account.

SECTION 2 - OUR SERVICES

Mini Builders Play Co. provides mobile, construction-inspired play experiences designed to encourage hands-on creativity, imaginative play, problem solving, coordination, and age-appropriate exploration.

Available activities, equipment, packages, event durations, staffing, service areas, participant limits, recommended ages, and pricing may vary.

We make reasonable efforts to accurately represent our Services online. Photographs, examples, activity layouts, equipment, decorations, materials, colors, and event setups are provided for reference and may vary from the Services provided at a particular event.

We reserve the right to modify, substitute, remove, or discontinue activities, equipment, materials, packages, or other portions of the Services when reasonably necessary due to availability, safety concerns, weather conditions, venue restrictions, participant needs, or circumstances outside our control.

SECTION 3 - BOOKINGS AND ORDERS

When you submit an event booking, reservation, order, or payment, you are making an offer to purchase Services from Mini Builders Play Co.

A requested event date or time is not guaranteed until your booking has been confirmed by Mini Builders Play Co. and any required deposit or payment has been received.

We reserve the right to accept or decline any booking or order at our discretion.

You are responsible for reviewing all booking information before submitting your reservation, including the event date, time, location, package selection, estimated number of participants, and any requested add-ons.

Changes requested after confirmation are subject to availability and may result in additional charges.

Purchases and bookings are subject to our Cancellation and Refund Policy.

SECTION 4 - EVENT DEPOSITS, PAYMENTS, AND CANCELLATIONS

Certain bookings may require a deposit or payment in advance to reserve an event date and time.

Unless otherwise stated, all required deposits must be received before an event is considered confirmed.

Remaining balances must be paid according to the payment schedule communicated at the time of booking.

Deposits, cancellation fees, rescheduling terms, and refunds are governed by our Cancellation and Refund Policy

If you need to cancel or reschedule an event, you must contact Mini Builders Play Co. as soon as reasonably possible.

Cancellations or rescheduling requests received within 2 weeks of the scheduled event may result in the loss of some or all payments made, subject to our Cancellation and Refund Policy.

Mini Builders Play Co. may cancel, postpone, modify, or reschedule an event due to severe weather, unsafe conditions, emergencies, illness, equipment problems, venue restrictions, or other circumstances that make providing the Services unsafe or impractical. In such circumstances, we will make reasonable efforts to provide an appropriate rescheduling, credit, or refund option according to our applicable policies.

SECTION 5 - PRICES AND BILLING

Prices, packages, discounts, promotions, travel charges, and add-on pricing are subject to change without notice.

The price applicable to your booking will generally be the price in effect when the booking is confirmed.

Unless otherwise expressly stated, advertised prices may not include applicable sales taxes, travel fees, delivery fees, venue fees, additional staffing fees, extended event time, or other charges associated with your particular event.

You agree to provide current, complete, and accurate billing and payment information.

You represent that you are authorized to use the payment method submitted and agree to pay all charges associated with your confirmed booking.

SECTION 6 - EVENT LOCATION AND SITE REQUIREMENTS

The person booking the event is responsible for providing accurate information regarding the event location and ensuring that Mini Builders Play Co. has reasonable access to the property or venue.

You are responsible for obtaining any permission required from property owners, event venues, homeowners associations, municipalities, parks, schools, churches, businesses, or other organizations before our arrival.

The event location must provide a reasonably safe, clean, accessible, and suitable area for the activities being provided.

Mini Builders Play Co. reserves the right to refuse to set up equipment or discontinue an activity if we determine that the location, weather, environment, participant behavior, or other circumstances create an unreasonable safety risk.

Additional charges may apply for excessive setup distances, stairs, difficult access, parking restrictions, travel outside our standard service area, or other special circumstances disclosed before the event.

SECTION 7 - PARTICIPATION, SAFETY, AND SUPERVISION

Mini Builders Play Co. activities involve physical play and the use of toys, tools, foam building materials, sensory materials, construction-themed equipment, or similar activity stations.

Participation involves ordinary risks associated with children’s play, including but not limited to trips, falls, collisions, minor cuts or scrapes, contact with equipment or other participants, and allergic or sensitivity reactions to certain materials.

Parents, guardians, event hosts, and supervising adults are responsible for determining whether participation is appropriate for each child.

Unless Mini Builders Play Co. has specifically agreed in writing to provide childcare services, our staff are activity facilitators and are not babysitters or childcare providers.

A responsible parent, guardian, or supervising adult must remain present and reasonably available during events involving minors.

Event hosts are responsible for providing sufficient adult supervision based on the number and ages of participating children.

Children must follow instructions provided by Mini Builders Play Co. staff and use activities and equipment as intended.

We reserve the right to temporarily or permanently stop a participant from using an activity if their behavior creates a safety risk to themselves, another participant, our staff, or our equipment.

SECTION 8 - PARTICIPANT HEALTH AND SPECIAL CONSIDERATIONS

Parents and guardians are responsible for informing Mini Builders Play Co. of any known allergies, medical conditions, physical limitations, sensory sensitivities, developmental considerations, or other circumstances that could reasonably affect safe participation.

You are responsible for determining whether any activity is suitable for your child.

Mini Builders Play Co. does not provide medical advice or medical supervision.

If a participant requires specialized medical, behavioral, or personal assistance, an appropriate parent, guardian, caregiver, or qualified individual must remain available during the event.

In the event of a medical emergency, Mini Builders Play Co. may contact emergency services when reasonably necessary.

SECTION 9 - DAMAGE TO EQUIPMENT

All Mini Builders Play Co. equipment remains the property of Mini Builders Play Co. unless specifically sold to the customer.

Normal wear resulting from appropriate use is expected.

The customer may be responsible for the reasonable repair or replacement cost of equipment that is intentionally damaged, removed, lost, stolen, or used in a manner inconsistent with instructions.

SECTION 10 - PHOTOGRAPHY AND MEDIA

Mini Builders Play Co. will not intentionally use identifiable photographs or video of participating children for advertising or promotional purposes without appropriate permission when required.

If photography or video release permission is requested separately, participation in the event does not itself constitute permission unless specifically stated in that release.

Event hosts are responsible for informing us of any venue-specific photography restrictions before the event.

SECTION 11 - INTELLECTUAL PROPERTY

The Services, including our trademarks, business names, logos, text, graphics, photographs, illustrations, videos, activity concepts, website content, and designs, are owned by Mini Builders Play Co., its affiliates, or its licensors and are protected by applicable intellectual property laws.

These Terms permit you to use our website and Services for personal, non-commercial purposes only.

You may not reproduce, distribute, modify, sell, republish, download, publicly display, or commercially exploit our content without our prior written permission.

The Mini Builders Play Co. name, logo, product names, service names, designs, and slogans may not be used without our prior written consent.

Shopify’s names, logos, products, and trademarks remain the property of Shopify or its applicable owners.

Mini Builders Play Co. is powered by Shopify, which enables us to provide certain online portions of the Services.

However, any bookings, purchases, or transactions made through our store are made directly with Mini Builders Play Co.

By using the Services, you acknowledge that Shopify is not responsible for the performance of Mini Builders Play Co. events or Services, including injuries, damages, losses, cancellations, or disputes arising from Services purchased through our website.

To the extent permitted by law, you release Shopify and its affiliates from claims arising specifically from your transactions or Services provided by Mini Builders Play Co.

Mini Builders Play Co. reserves the right to discontinue an event or individual activity if participants, guests, customers, or other individuals engage in threatening, violent, abusive, dangerous, discriminatory, destructive, or otherwise inappropriate behavior.

Our employees and representatives are entitled to a safe working environment.

If an event is terminated because of unsafe or inappropriate conduct by the customer, participants, or guests, amounts already paid may be non-refundable.

SECTION 20 - WEATHER AND CONDITIONS OUTSIDE OUR CONTROL

Some Services may be affected by weather.

Mini Builders Play Co. may decline to operate activities outdoors during rain, excessive heat, high winds, lightning, unsafe air quality, extreme temperatures, or other conditions we reasonably believe may create an unsafe environment.

We are not responsible for delays or inability to perform caused by circumstances outside our reasonable control, including natural disasters, severe weather, government restrictions, road closures, power outages, venue closures, emergencies, labor disruptions, or similar events.

Rescheduling or refunds in these circumstances will be handled according to our Cancellation and Refund Policy.

We may terminate or restrict your access to the Services if you materially violate these Terms or engage in conduct that creates an unreasonable legal, financial, operational, or safety risk.

Any payment obligations incurred before termination remain due.

Sections concerning intellectual property, liability, indemnification, privacy, governing law, and other provisions that by their nature should survive termination will continue to apply.

You acknowledge that children’s recreational and physical activities involve inherent and ordinary risks.

Parents and legal guardians are responsible for determining whether participation is suitable for their children and for providing appropriate supervision.

To the fullest extent permitted by applicable law, Mini Builders Play Co., its owners, employees, contractors, agents, affiliates, and service providers will not be liable for indirect, incidental, special, punitive, or consequential damages arising from the use of our website or Services.

Nothing in these Terms is intended to waive or limit liability where such a waiver or limitation is prohibited by law.

Any separate participation waiver, release, or event agreement signed in connection with an event is incorporated into these Terms where applicable. If a conflict exists between these Terms and a separately executed participation waiver regarding participation risks, the executed waiver will control to the extent permitted by law.

To the extent permitted by law, you agree to indemnify and hold harmless Mini Builders Play Co., Shopify, and our respective affiliates, employees, agents, contractors, licensors, and service providers from third-party claims, damages, liabilities, or reasonable legal expenses arising from your material breach of these Terms, your violation of applicable law, or your infringement of the rights of another party.

Mini Builders Play Co. may assign or transfer its rights and obligations as permitted by law.
